DUI vs Distracted Driving.
In Florida, texting while driving can result in fines, points on your license, and jail time.
A first offense can result in a $30 fine and three points.
A second offense can result in a $60 fine and three points.
Texting while driving and causing an accident can result in six license points and an arrest
Subsequent offenses can result in up to five years in jail.
BUT
DRIVING WITH ANYTHING IN YOUR SYSTEM(even .02 bac or if officer THINKS your normal faculites are impaired
(AND ONLY .08 + IS ACTUALLY ILLEGAL) IS 1000.00 FINE COURT COST DUI SCHOOL AND THERAPY POSIBLY JAIL
The big question is how do they know you are impaired. They could use the FSTS (field sobriety test for texting since studies show only 1 out of three people can pass them sober)
maybe the HGN test given a night with a flashlight oncomming traffic as opposed in a clinical setting where you can actually see results.
nhtsa SAYS STATISTICS SHOW 6 TIMES MORE ACCIDENTS OCCUR FROM DISTRACTED DRIVING THAN DIVING WITH ALCOHOL.
Ask anyone what they think about dui laws and so far all I have heard is its about money ! This is what people believe! I believe the reason is justified(driving drunk is wrong, but dont convulute the law for your own agenda or by passing laws that allow too much room for abuse).
Set the limit and stick to it. I also believe the court system gets involved to make you PAY(teach you a lesson while adding to their bounty).
The issue is if congressmen or senators enact a law the people may vote them out of office(which is why they have not passed a .05 BAC) so LE has convinced them to add laws that give them the ability to convulute the actual law to fit LE agendas

one idea if LE thinks you are imparied why not just do a driving simulation test !!!!
I went through dui arrest and every class, the therapy discussions was asked How much did it cost you!! If this technique is to slow down drunk driving why focus at the ones that
have been caught! LE have signs over the highway that say "Bussed driving is drunk driving" would not .08 is dui .01-.079 is reckless and we will prosecute!!! more accurate
WHY? The DMV has set a legal B.A.C. limit as a condition of acquiring a driving license . We also agree to any testing and therapy the dmv deems appropriate to
keep our license(even anger managemnent if thats what they want).So if your BAC is under why not just let you go.The answer is TO MAKE YOU PAY.
My question is why then do they need to make it a crime unless there is bodily injury or property damage.
They call anything with alcohol .08 or not reckless driving. They feel any alcohol should not be consumed if driving. This includes texting ,being upset or even eating while driving.
This agressive attitude and recent laws are alarming. Some proponents say this is not agressive enough, but in reality dui have increased as the laws get tougher.
We believe that thses laws should be more definitive. Identify what is reckless driving and apply the bac levels to it as they have with speeding.
We have all seen the signs "bussed driving is drunk driving" but what does that even mean. It means if an officer thinks you have had any alcohol
they need to prove a PC snd take you to jail. Let the courts offer a plea deal even if there was NO drugs(cause they will often find some kinda of drug that can coroboratw the officers opinion) or alcohol in system(getting it dmissed is almost impossible). (yes it happens)
sometimes its simply a biased officer's opinion. They are given way to much leeway in making these decisions. Remember being arested will be there forevewr and the courts will do their
best to convict you of at least reckless but may withold conviction so you wont spend another $4000.00 and go to trial.
Remember also thet even if you walk out of court as not guilty the dmv can and will force you to dui school and several months of drug and alcohol abuse treatment
that you will pay for or they can take your license.
